End User License Agreement

Dear User, thank you for choosing to use the Clock Talker application. To clarify the rights and obligations of both parties and protect your legitimate rights and interests, this Service Agreement is hereby established. Before using this application, please carefully read the following terms. Your continued use of the application constitutes your full understanding and acceptance of all provisions of this Agreement.

 

I. Description of Service Content

(1) Basic Functions

The application provides the following basic services free of charge to all users:

  1. Two basic alarm clocks and two timers with limited configurable options.

  2. The right to use a selection of preset ringtones, voice alerts, and music.

(2) Premium Services

Users can unlock premium privileges through subscription, specifically as follows:

  1. Users are granted access to a maximum of 24 alarms and 24 timers, along with full operational rights to all available configuration options associated therewith;

  2. Users shall obtain authorization to use all built-in ringtones in the application;

  3. Users may use the recording function to create personalized ringtones.

 

The application will continuously optimize the service experience and may irregularly add new functions based on actual circumstances. Relevant adjustments will be notified to users through in-app announcements and other means. Before subscribing to premium services, users are advised to fully understand their own needs and usage scenarios, and carefully select the subscription period and payment method. Meanwhile, to ensure smooth enjoyment of services, it is recommended to keep Apple account information accurate and valid to receive relevant notifications and services.

 

II. Subscription Service Details

(1) Charging and Renewal Management

  1. Subscription prices will be prominently displayed on the in-app purchase page for real-time review by users.

  2. Regarding auto-renewal services, the application will strictly comply with relevant regulations and push renewal reminder notifications to users via their Apple accounts before the expiration of each subscription period to ensure users are fully informed of renewal-related information.

(2) Subscription Management

Users may manage their subscriptions through iOS devices via the following procedures:

  1. Go to "Settings" on the device and click "Apple ID";

  2. Select the "Subscriptions" option and locate the Clock Talker application;

  3. Freely choose to disable the auto-renewal function according to personal needs.

(3) Refund Handling

In the event of the following situations:

  1. There is a significant deviation between the functions actually provided by the application and the official description, failing to meet the standards of function display and promotional commitments;

  2. Unauthorized and unexplained repeated deductions occur, causing financial losses to users.

 

Users may submit refund requests through the Apple Official Refund Channel, and the application will actively cooperate with Apple to complete relevant processing.

 

III. User Responsibilities and Obligations

(1) Compliance Requirements

When using this application, users shall comply with relevant laws, regulations, and the provisions of this Agreement, including but not limited to the lawful use of the recording function, refraining from recording content that infringes on the privacy or other legitimate rights and interests of others, and properly safeguarding personal account information to prevent account theft or disclosure.

(2) Measures for Violations

If a user is found to have engaged in illegal activities or uploaded illegal content, the application reserves the right to take the following measures:

  1. Issue a written rectification notice to the user and require the user to delete the illegal content within a specified time limit, providing technical assistance if necessary;

  2. If the violation is severe, the application may, depending on the circumstances, take measures such as suspending or terminating the user's service.

 

IV. Service Changes and Interruptions

(1) Service Optimization and Adjustments

To improve service quality, the application may make the following adjustments:

  1. Upgrade or optimize the functional modules of the application, including but not limited to enhancing the performance and stability of alarm clocks and timers.

  2. Simplify and optimize service processes, such as adjusting the interaction logic of the alarm clock settings interface to improve user operational convenience.

  3. The platform will timely add new service functions. Relevant functional changes will be fully notified to users via in-app announcements, internal messages, and other means before official launch.

  4. The platform will carry out optimization and adjustment of the application's interface design to enhance the user experience.

(2) Service Interruption Handling

In the event of service suspension due to force majeure or other objective reasons, the application will:

  1. The Company will formally notify users in advance through official channels such as in-app announcements and internal messages;

  2. For subscribed users, the Company will strictly protect users' legitimate rights and interests in accordance with relevant laws, regulations, and this Agreement, and minimize the adverse impact of business adjustments on users.

 

(1) Applicable Law and Dispute Resolution

  1. This Agreement shall be governed by the laws and regulations of the country/region where the user is located;

  2. In the event of a dispute arising from this Agreement, the parties shall first seek resolution through friendly consultation; if consultation fails, either party may initiate legal proceedings in a people's court with competent jurisdiction in accordance with the law.

(2) Relationship with Apple Inc.

In accordance with the relevant regulations of the Apple App Store:

  1. Apple Inc. is not the liable party under this Agreement;

  2. If a user commits a serious breach of contract, Apple Inc. reserves the right to take necessary measures in accordance with its relevant rules.

  2. Emergency Handling: For urgent matters requiring priority processing, users may mark "[Urgent]" in the email subject line, and we will prioritize assigning a dedicated team member to follow up.

 

VII. Miscellaneous Provisions

  1. Users' continued use of the application constitutes their acceptance of the entire content of this Agreement;

  2. If any changes are made to this Agreement, users will be notified via application update prompts and other means. Users' continued use of the application after the changes to this Agreement shall be deemed their acceptance of the revised agreement.
